Terms and Conditions
Last updated: 25 September 2026
1. Scope
These Terms and Conditions (the “Terms”) govern all contracts for the use of software and digital content offered via the website slohmaier.com, concluded between
Stefan Lohmaier
Weitlstr. 103
80935 Munich
Germany
(the “Provider”) and the respective customer.
A consumer is any natural person who enters into the contract for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity. An entrepreneur is any natural or legal person or partnership with legal capacity acting in the exercise of their commercial or independent professional activity.
For entrepreneurs, individually agreed terms take precedence. Conflicting terms and conditions of the customer do not become part of the contract, even if the Provider does not expressly object to them.
2. Subject matter of the contract
The Provider develops and sells accessible software for Windows, macOS and Linux. The subject matter of the contract is the grant of a right to use the respective software and the provision of the associated digital content. The software itself is not sold; what is sold is the licence to use it.
The specific scope of functions is determined exclusively by the product description on the respective product page at slohmaier.com. No characteristics beyond that are warranted. Statements in advertising, presentations or demonstrations are not statements of characteristics unless expressly confirmed in writing as such.
The Provider is entitled to further develop individual products, to change functions or to discontinue products. For ongoing subscriptions, Section 15 applies.
3. Formation of the contract
The presentation of products on the website does not constitute a legally binding offer but an invitation to place an order.
The customer places the order through the ordering process of the payment service provider used. The order is a binding offer by the customer to conclude the contract. The contract is formed when the Provider accepts the order by providing the download link and/or the licence key, or by sending an order confirmation.
Payment is processed by a payment service provider acting as Merchant of Record. The terms of the payment service provider apply in addition to the payment process. The Provider does not receive or store payment data such as credit card or account numbers.
The contract language is German. The Provider does not separately store the contract text. The customer receives an order confirmation by email; that confirmation and the version of these Terms valid at the time form the contract documents.
4. Prices and payment terms
All prices are final prices in euros and correspond to the amounts stated on the respective product page.
The Provider is a small business within the meaning of the German small-business regulation (Section 19 UStG) and does not show VAT separately. The VAT treatment of the purchase towards the customer follows the rules of the payment service provider as the seller.
The available payment methods are shown in the payment service provider’s ordering process. For recurring services, the respective amount is due in advance at the beginning of each billing period.
The customer is responsible for providing the technical requirements for use, in particular an internet connection and a suitable device.
5. Provision
The software is provided by electronic transmission. After successful payment, the customer receives a download link and/or a licence key. Delivery of a physical data carrier is not owed.
The Provider provides the software in the version current at the time of the order.
6. Licence and scope of use
The Provider grants the customer a simple, non-exclusive, non-transferable and non-sublicensable right to use the software for their own purposes. Purchasing a licence key does not create ownership of the software.
A licence key entitles the customer to activation on the number of devices stated on the product page. The licence is personal; passing it on to third parties or use by several persons is not permitted unless stated otherwise on the product page.
The scope of the right of use depends on the type of licence:
- For a one-time purchase, the right of use covers the acquired version of the software and the updates stated on the product page.
- For a subscription, the right of use covers use for the duration of the respective term.
In particular, the following are not permitted: reproducing, distributing, renting or making the software publicly available; modifying or decompiling it, insofar as mandatory statutory provisions do not allow this; removing or altering copyright or origin notices; circumventing technical protection measures or licence-checking mechanisms.
Where the software contains third-party components, in particular free software under the GNU Lesser General Public License, the customer’s rights under those licences remain unaffected. The relevant licence notices are linked on the respective product page and included with the application.
7. Trial versions
Where a free trial version is offered for a product, it may be used free of charge. The trial version runs entirely locally on the customer’s device and transmits no data to the licence server. The Provider may change, restrict or discontinue the trial version at any time; there is no entitlement to a trial version.
After the trial period ends, the software can only be used further if a licence is purchased.
8. Updates and support
The nature and scope of updates and support are set out in the description of the respective product. There is no entitlement to specific future functions.
The Provider accepts support requests via the contact channels stated on the website. The Provider handles requests during normal business hours; a response time in hours or working days is not warranted unless expressly agreed.
9. Term and cancellation of subscriptions
Subscriptions are concluded for the period stated on the product page (monthly or annual). They renew for the respective period unless cancelled before it expires.
Cancellation can be declared via the customer management provided by the payment service provider or via the Provider’s contact channels. What counts for timely cancellation is receipt by the Provider or timely execution via the customer management.
The right of either party to terminate for good cause remains unaffected. After the term ends, the right of use ends; the software can then no longer be used activated.
Details on the refunding of amounts already paid are governed by the Refund Policy.
10. Right of withdrawal
Consumers have a statutory right of withdrawal. The details, in particular the withdrawal period and the conditions under which it expires, are set out in the separately provided withdrawal instructions.
For digital content and digital services, the right of withdrawal expires when the Provider has begun performance of the contract, the consumer has expressly consented to the Provider beginning performance before the withdrawal period expires, and the consumer has confirmed that they lose their right of withdrawal upon the beginning of performance.
11. Warranty and liability for defects
The statutory warranty rights apply, in particular the provisions on digital products under German law.
The customer must report recognisable defects without undue delay, stating a comprehensible description of the defect. The Provider is entitled to remedy defects by subsequent performance, that is, by repair or by providing a defect-free version.
The Provider may refuse subsequent performance insofar as it involves disproportionate costs.
12. Liability
The Provider is liable without limitation for intent and gross negligence, for injury to life, body or health, for fraudulently concealing a defect, and under the German Product Liability Act.
For simple negligence, the Provider is liable only for breach of a material contractual obligation, that is, an obligation whose fulfilment is essential for the proper performance of the contract and on whose observance the customer may regularly rely. In that case, liability is limited to the foreseeable damage typical for the contract.
Beyond that, liability is excluded. The exclusion also applies to the Provider’s vicarious agents.
The Provider is not liable for data loss caused by the customer’s own conduct or by the customer’s failure to keep a backup. The customer is obliged to back up their project files and data regularly.
13. Availability of the licence service
Licence activation and validation require that the licence service at lic.slohmaier.com is reachable. Details on offline use are set out in the description of the respective product.
The Provider endeavours to achieve high availability but does not owe uninterrupted reachability. Maintenance work and disruptions outside the Provider’s sphere of influence can lead to temporary restrictions. Statutory warranty rights under Section 11 remain unaffected.
14. Data protection
The processing of personal data is governed by the Privacy Policy and, for licensed products, by the product-specific privacy notice. Both are accessible on the website.
15. Changes to these Terms
The Provider may amend these Terms with effect for future contracts. For ongoing subscriptions, an amendment applies unless the customer objects within six weeks of receiving the notice. If the customer objects, the Provider may terminate the contract at the end of the current billing period. The notice expressly points out the consequences of objection.
16. Applicable law, jurisdiction, dispute resolution
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Towards consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of their country of habitual residence.
If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Munich.
The Provider is not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
